If the contract is created prior to marriage and goes into effect upon marriage, it’s called a prenuptial agreement, but if it’s created and executed during the marriage, it’s called a postnuptial agreement. Prenuptial and postnuptial agreements neither hasten nor encourage divorce, and because they take the guesswork out of divorce terms – laying bare the consequences – they help some couples build stronger relationships and stay together.
